Kenny Chiu’s proposed bill for foreign registry had raised concerns over racial discrimination. While Beijing’s misinformation campaign accused it of being prejudiced against the Chinese community, Trudeau also tried to reject the proposed bill by playing the race card, saying that “requiring people to register if they are working in Canada for a foreign government was somehow a form of racism.” But rather than broadly targeting all members of the Chinese Canadian community, the proposed bill would only keep track of agents acting on behalf of foreign governments. Moreover, it would give the local authorities the ability to charge and arrest Chinese agents secretively sent to Canada to silence divergent voices of CCP.

Beijing has sent agents abroad to establish police stations in Canada and US. The requirement that someone be registered to act on behalf of a foreign government has been in place in the United States since 1938. Under the US foreign agent registration act, the FBI shut down a Chinese police station in Lower Manhattan and arrested two alleged Chinese agents who operated an “undeclared police station” in New York City. Lu Jianwang and Chen Jinping faced charges of conspiring to act as agents of the Chinese government without informing US authorities and obstructing justice. Lacking such a registry system renders Canada’s law enforcement agencies powerless, allowing China to engage in more brazen activities to violate Canadian sovereignty, popping up more police stations on Canadian soil. When the FBI broke into the home of Lu and Chen and made the arrest, RCMP in Canada could barely take any enforcement actions but merely parked police vehicles in front of the four suspected illegal police stations – “to show their presence.”

An army of secret agents sent to the US harass, stalk, and surveil Chinese critical of the Chinese government. The US Justice Department announced charges against 34 officers of the national police of the PRC involved in “transnational repression” scheme that harms people living in the US. Among them was 62-year-old Frank Liu from Long Island, who allegedly hired private investigators to illegally collect tax records and other derogatory information about several Chinese dissidents, including Chen Jimin, a California artist, whose sculpture depicting Xi Jinping as a Covid-19 virus molecule had drawn the ire of Chinese authorities. Liu asked the investigator to obtain tax records, offering to pay $3,500 to bribe an Internal Revenue Service agent into illegally releasing the documents. The investigator did not bribe an IRS official. Instead, he contacted the FBI, which charged Liu with conspiring to act as an agent of the PRC secret police.

Many Chinese people in Canada have suffered similar intimidation, harassment, and abuse from Chinese agents as Mr. Chen and other US counterparts. While under the US foreign registry law, individuals can’t covertly operate and work for a foreign government without declaring it to the government, that activity is not illegal in Canada. “So it is a very stark contrast where we see charges brought against individuals in the United States for doing this activity but not in Canada,” said Dennis Molinaro, a former national security analyst. The inability of the Canadian authorities to hold Beijing’s illegal operations accountable would only encourage the perpetrators while putting the victims in more harm. By setting up a foreign registry system, those in the Chinese community facing CCP’s harassment and crackdown will get protection from law enforcement agencies. At the same time, many more silent dissents can have their fear relieved, feeling the taste of freedom.
